Every business entity in South Africa must comply with PoPIA and PAIA. No pun intended!
With the 2025 PAIA reporting deadline fast approaching, here’s what you need to know:
PAIA vs PoPIA — What’s the difference?
PAIA = Access law → Freedom of Information
PoPIA = Privacy law → Protection of Personal Info
What does Section 32 of PAIA say?
The Information Officer of every public body must submit an annual report to the Information Regulator on access to information requests.
BUT — the Regulator now requires private bodies to do the same!
Who needs to submit?
If you're the Information Officer for a business (yes, even small private companies), this duty falls to you.
Deadline:
Reports must be submitted by 30 June 2025.
This follows the Notice published by the Regulator on 17 March 2025.
